EDS sues partners

Hewlett-Packard’s Electronic Data Systems unit sued business partners CA and Ingres in Delaware court over rights to a software license valued as high as $20 million. The dispute, intertwined with another Delaware lawsuit filed by CA against Ingres and a third in California, involves a new release of Ingres’ OpenRoad software, which helps programmers write software for complex networks, according to court papers. Dallas-based EDS gets Ingres support through CA. Hewlett-Packard bought EDS last year. The most recent Delaware case was filed by EDS on Tuesday. A public summary of the complaint claims CA and Ingres breached a contract and are interfering with EDS’s rights to the license. Islandia, N.Y.-based CA sued Jan. 20 in the Delaware court asking a judge to prevent Redwood City-based Ingres from prosecuting a lawsuit against it in San Mateo County over the contract. In the California suit, Ingres seeks damages from CA. CA contends in court papers that Ingres is required to provide services under a “legacy support agreement” for OpenRoad customers.

Issuing more stock

Intel’s plan to offer $1 billion in new stock gives the world’s largest computer-chip maker more flexibility to make acquisitions, CEO Paul Otellini said. “It gives you one more arrow in your quiver,” Otellini said Thursday in an interview. Intel typically makes “small acquisitions,” Otellini said, echoing comments from the company last week that it has no specific acquisition plans for the stock offering.
